These Terms of Use ("Terms") govern your access to and use of the NextYou mobile application, website, and related services (together, the "Services"), provided by NextYou Innovative Solutions Pvt Ltd ("NextYou," "we," "us," or "our"). By creating an account or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Services.

Eligibility & Accounts

You must be at least 18 years old to use NextYou. By registering, you confirm that the information you provide is accurate and that you will keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

If you access NextYou through an employer or organisation plan, your organisation's administrator may have visibility into aggregate, de-identified usage metrics only, as described in our Privacy Policy. Your individual scores, voice data, and calendar data remain private to you.

Description of the Services

NextYou is an autonomous nervous system recovery application. Using signals such as voice acoustics, calendar data, and screen-time patterns, NextYou's system (including our AI companion, Nuo) detects stress and delivers personalised audio sessions (including binaural, monaural, and isochronic frequency-based tracks) without requiring you to initiate a session. Features, functionality, and the specific signals used may change over time as described in our Privacy Policy.

License to Use NextYou

Subject to your compliance with these Terms, NextYou grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the app and its content for your own individual, non-commercial use. This license does not permit you to:

  • Copy, reproduce, distribute, broadcast, publicly perform, or resell any audio content, session, or feature of NextYou

  • Use the Services, or any output of the Services, for any commercial purpose, including as part of a product, service, or offering you provide to others

  • Reverse-engineer, decompile, or attempt to extract the underlying methodology, models, or source code of NextYou's recovery calculations or audio generation systems

  • Use automated means (bots, scrapers, or similar tools) to access or extract content from the Services

  • Sublicense, rent, lease, or otherwise make the Services available to any third party

Audio Content License

All audio sessions, tracks, and soundscapes made available through NextYou are strictly licensed to you for personal listening within the app, and remain the exclusive property of NextYou Innovative Solutions Pvt Ltd or our licensors. No ownership rights are transferred to you. You may not download, extract, re-record, redistribute, sublicense, or use this audio content outside of the NextYou app, or for any commercial purpose, without our prior written consent.

Proprietary Recovery Calculations

The methodology, algorithms, and models NextYou uses to compute your Stress Score, Recovery Score, Daily Load, and any related metric (collectively, "Recovery Calculations") are proprietary to NextYou and protected by intellectual property law. Recovery Calculations, and any output derived from them, are provided solely for your personal use within the Services and may not be reproduced, reverse-engineered, republished, or used for any commercial purpose, including for research, product development, or competitive benchmarking, without our prior written consent.

Intellectual Property

The Services, including all software, text, audio, graphics, logos, the Nuo name and character, and all other content (excluding content you submit), are owned by NextYou or our licensors and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

Medical Disclaimer

NextYou is not a medical device and does not provide medical advice, diagnosis, or treatment.

The suggestions, recommendations, scores, and audio sessions provided through NextYou are intended for general wellness purposes only. They are designed to support everyday stress recovery and are not a substitute for professional medical, psychiatric, or psychological care.

NextYou's Stress Score, Recovery Score, and related outputs are estimates derived from indirect signals (such as voice acoustics and calendar patterns) and should not be interpreted as a clinical or diagnostic assessment of your physical or mental health.

If you are experiencing a deep, persistent, or serious mental or physical health concern, or if you are in crisis, please consult a certified physician, licensed therapist, or other qualified healthcare professional. Do not rely on NextYou as a substitute for such consultation, and do not delay seeking professional care because of anything you experience while using the Services. If you are experiencing a medical emergency, contact your local emergency services immediately.

Subscriptions & Payment

Certain features of NextYou require a paid subscription. Prices, billing cycles, and renewal terms will be presented to you at the time of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period. Payments are processed by third-party payment processors; NextYou does not store your full card details.

User Conduct

You agree not to use the Services to:

  • Violate any applicable law or regulation

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

  • Interfere with or disrupt the integrity or performance of the Services

  • Attempt to gain unauthorised access to the Services, other accounts, or related systems

Third-Party Services

NextYou may integrate with third-party services (such as calendar providers or, in future, wearable devices) to provide certain features. Your use of any third-party service is governed by that provider's own terms, and we are not responsible for their availability, accuracy, or practices.

Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services if you violate these Terms, or for any other reason, with or without notice, to the extent permitted by law. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any Recovery Calculation or recommendation will achieve any particular outcome.

Limitation of Liability

To the fullest extent permitted by applicable law, NextYou and its officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of or inability to use the Services.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised "last updated" date, and for material changes, we will notify you through the app or by email. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.
